Beginning of the end?

It is a matter of great pride for the Indian Ampoule to have successfully achieved the first leg of their crusade against the anti competitive and monopolistic practices of Schott Glass in India.
The Competition Commission of India passed the order yesterday and it is now under public domain for the World to read and a special message for our Ampoule and Vial producers across the Globe to take a cue and retaliate in case such practices are being adopted by Schott in your part of the World.

Kapoor Glass filed a complaint against Schott Glass for Antitrust and Monopolistic Practices, which after an in depth investigation, carried out by the Competition Commission of India, has proved beyond reasonable doubt the anticompetitive and unfair practices of Schott Glass in India.
This is a 1st time any transformer in the World who has challenged the might of this German Giant who normally professes high level of ethics, fair play, transparency etc but the investigation has exposed the murky dealings of Schott Glass who can and has stooped to a new low in India with total disregard for business ethics and morals.
Since the order has left some issues open we have no choice but to appeal before the Appellate Authorities to review the order on some crucial issues such responsibilities and punishment of the Directors of the accused company as laid under Section 48 of the Competition Act, reasons for not imposing penalties towards Schott AG for their role in this misconduct and refusal to deal especially when the Commission has found Schott guilty for abuse of dominance etc.
It may not be out of place to state here that this is the second time in the last few months Schott has been found guilty and penalized by the Anti Trust bodies, the first being US$40.4 Million for price fixing of Glass.
Before ending this message I take the opportunity to thank each and every person who was associated to make this happen from CCI, Office of the Director General of Investigation, Pharmaceutical Companies and last but not the least my friends in the glass fraternity who vehemently supported our cause.
I truly believe in the proverb “WHERE THERE IS A WILL THERE IS A WAY”. I alone know the hurdles and obstacles Kapoor Glass Team faced in India but all is well that ends well.

In the last post we brought out to all of you the reply given to us by Prof. Udo – Chairman of the Management Board Schott AG – on 8th April, 2009; approximately 3 weeks after our email to him and many years of meetings and written communications with his colleagues in India and Germany.
A reply to his letter was given instantly and the same is attached below for you to be able to take a decision on whether or not Schott is seriously working towards a resolution or just playing games.
Keep watching this space and I am sure you will have NO doubts as to what extent Schott can drop to DESTROY competition or anybody that doesn’t toe their line.
